Terms of Service

By accessing or using PikPook (the "Service") operated by PikPook Technologies Pvt. Ltd. ("PikPook," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service.

These Terms apply to all users, including visitors, registered users, and paid subscribers. We reserve the right to modify these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will provide at least 14 days' notice for material changes via email.

You must be at least 13 years old to use PikPook. Users between 13 and 18 years old require verifiable parental or guardian consent. By using the Service, you represent that you meet these age requirements.

You must provide accurate and complete registration information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You are responsible for safeguarding your password and for any activity under your account, whether or not authorized by you. Notify us immediately at support@pikpook.com if you suspect unauthorized access.

You may not share your account with others, create multiple free accounts to circumvent the free token limit, use automated scripts or bots to create accounts, or use another person's account without permission.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a security risk to the platform.

Token Economy: PikPook uses a pay-as-you-go token system. Tokens are a digital credit used to pay for AI generation services within the platform. 1 token = $0.008 in generative compute cost. Token prices may change; we will notify users with 30 days' advance notice.

Purchases: Token packs are one-time purchases and are non-recurring. By making a purchase, you authorize us to charge your payment method for the selected amount. All prices are in USD unless otherwise stated.

No Expiry: Purchased tokens do not expire and remain on your account indefinitely. Free trial tokens granted on signup have no expiry.

Refunds: Unused tokens are eligible for a full refund within 30 days of purchase. See our Refund Policy for full details and conditions.

Failed Payments: If a payment fails or is reversed (chargeback), we reserve the right to suspend your account and recover the value of tokens already consumed.

Taxes: Prices exclude applicable taxes. You are responsible for any applicable GST, VAT, or sales tax in your jurisdiction.

You agree to use PikPook only for lawful purposes and in a manner consistent with these Terms. You may NOT use the Service to:

Prohibited Content: Generate or distribute content that is sexually explicit involving minors (CSAM), depicts real people in non-consensual sexual or violent scenarios, constitutes defamation or deliberate disinformation targeting a real individual, promotes terrorism, genocide, or mass violence, violates any applicable laws or regulations, or infringes the intellectual property rights of third parties.

Platform Abuse: Attempt to reverse-engineer, hack, or disrupt the Service; conduct denial-of-service attacks; scrape or crawl the platform without permission; resell PikPook API access without authorization; use the Service to develop a competing product that replicates PikPook's core functionality.

Misrepresentation: Impersonate PikPook staff, other users, or any entity; create fake accounts; misrepresent the AI-generated nature of content where disclosure is required by law.

We use automated and manual review to detect violations. Accounts found in violation will be suspended or terminated without refund.

Your Content: You retain ownership of the prompts you submit and the AI-generated outputs you create on PikPook, subject to the licenses granted below and the underlying AI model providers' terms.

License to PikPook: By using the Service, you grant PikPook a limited, non-exclusive, royalty-free license to store, process, and transmit your prompts and generated content solely for the purpose of providing and improving the Service. We do not use your specific prompts or outputs to train AI models without your explicit consent.

Commercial Rights: You may use content generated on PikPook for commercial purposes, including in client work, products, advertising, and resale, subject to the terms of the underlying AI model provider (e.g., OpenAI's usage policy for DALL-E outputs).

Platform Content: PikPook's interface, branding, documentation, and all non-user-generated content remain the exclusive property of PikPook Technologies Pvt. Ltd. and may not be reproduced without permission.

PikPook aggregates multiple AI model providers (OpenAI, Stability AI, Runway ML, Google, Black Forest Labs, ElevenLabs, etc.). Your use of specific models is also governed by each provider's terms of service and content policies.

We are not responsible for the accuracy, quality, or appropriateness of AI-generated outputs. AI models can produce unexpected, inaccurate, or offensive content. You are responsible for reviewing and appropriately using any generated content.

Provider availability, model capabilities, and pricing may change without notice. We will make reasonable efforts to notify users of significant model changes.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) any generated content will be accurate, appropriate, or free from errors; (c) results obtained from the Service will meet your requirements or expectations.

AI-generated content may contain errors, inaccuracies, biases, or material that some find offensive. You use all generated content at your own discretion and risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PIKPOOK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR: (A) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; (B) LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES; (C) DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE.

Our total cumulative liability to you for all claims arising from or related to the Service shall not exceed the greater of: (a) the amount you paid to PikPook in the 12 months preceding the claim; or (b) USD $50.

Some jurisdictions do not allow limitation of liability for certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless PikPook and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you generate, publish, or distribute using the Service.

You may terminate your account at any time by visiting Settings > Delete Account, or by contacting support@pikpook.com. Upon termination, your access to the Service ends immediately and your generated content will be deleted within 30 days.

We may suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent behavior, or if we are required to do so by law. In case of termination due to Terms violation, no refund will be issued for unused tokens.

We reserve the right to discontinue the Service at any time with 60 days' written notice to registered users. In such event, we will offer a pro-rated refund of unused purchased tokens.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved after 30 days, disputes shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act 2015, conducted in Bengaluru, Karnataka, India, in English.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a competent court.

Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and PikPook regarding the Service.

Severability: If any provision of these Terms is found unenforceable, that provision shall be modified to the minimum extent necessary or severed, and the remaining provisions shall continue in full force.

No Waiver: Failure by PikPook to enforce any provision of these Terms shall not constitute a waiver of future enforcement of that or any other provision.

Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. PikPook may assign these Terms freely.

Force Majeure: Neither party shall be liable for delays or failures caused by circumstances beyond their reasonable control, including natural disasters, government actions, or third-party service failures.
